Court Brings Hilton Management to Victory

TEMPO Interactive, Jakarta: The South Jakarta District Court granted the civil suit of the Hilton Hotel’s management, PT Indobuildco, for the case of the building rights extension. “The building rights extension given to Indobuildco was legal and has a legal base,” said head of the judges panel Machmud Rachimi, when reading the verdict at the South Jakarta District Court yesterday (8/1).
Indobuildco as the Hilton Hotel (now the Sultan Hotel) management filed a suit against the State Secretary, the Attorney General’s Office and the National Land Agency (BPN). Indobuildco sued the State Secretary because the right to work the land owned by the State Secretary over land in Bung Karno Sports Complex. The right was obtained based on BPN’s letter on August 12, 1989.
Indobuildco rejected this. The reason is Indobuildco has already obtained the Hilton area building rights first, in 1973. Indobildco also obtained building rights extension issued in 2002, so it is assumed that the right to work the land of the State Secretary as the Management of Bung Karno Sports Complex was legally defective.
Judge Machmud said the State Secretary’s right to work the land in 1989 is legally defective. According to him, the right cannot be issued as long as there are building rights.
In response to the verdict, the State Secretary’s legal advisor Husen Adiwisastra said he was disappointed. According to him, the judges did not consider evidence during the trial. He said the right to work the land was issued based on a letter which had the measurements issued by BPN. “We will have an appeal,” he said after the trial.
The appeal is through the AGO. Purwani Utami, representing the AGO, said the case should have been checked at the Administration of Justice. In addition, if one is not satisfied with AGO’s investigation, he or she can file suit via a pre-trial, not a civil suit.
