Dossiers in Ba’asyir’s Case Handed Over to Jakarta High Court

TEMPO Interactive, Jakarta:National Police anti terror Director Brig. Gen. Pranowo Dahlan told reporters at the National Police headquarters (HQ), on Monday (07/06), that the dossiers for Abu Bakar Ba’asyir’s case had been delivered to the Jakarta High Court last week on Tuesday (01/06).

Dahlan added,” The Jakarta High Court has yet to return the dossiers to the police.”

Meanwhile, the investigation carried out by the police into Indonesian Mujahidin Council (MMI) supreme leader Abu Bakar Ba’asyir continues.

Dahlan went on to say that Ba’asyir, alleged to be leader of Jamaah Islamiyah organization, was charged unders article 14,15 and 17 of Law number 15/2003 on terrorism acts.

If proven guilty, he might be sentenced to life in prison.

The South Jakarta District Court held a pre-trial session on Ba’asyir’s lawsuit against the National Police on Monday (07/06).

Ba’asyir made this lawsuit for several reasons such as how he should have been released from Salemba penitentiary on April 30, when his jail sentence ended.

Instead, he was detained once again by the police.

Ba’asyir also felt there had been intervention and pressure made against the legal sovereignty of Indonesia over his case, that is by urging his re-trial in relation to terrorism planning and activities.

In addition, Ba’asyir considered his constitutional and human rights, based on the 1945 Constitution article 28, Terrorism Eradication Law, Law number 39/1999 article 18 sub section 5 and article 34 on human rights, have been violated by the police. (R.R Ariyani & Martha Warta - Tempo News Room)
