Court Reject Review on Tax Case By Bakrie Company

TEMPO Interactive, Jakarta: The South Jakarta District Court has rejected on Tuesday the pre-court motion from a coal miner under the Bakrie & Brothers group who complained over the tax evasion investigation in the company and by the tax office.
The motion by PT Kaltim Prima Coal challenged the Taxation Directorate's procedure in investigating the tax evasion allegations in the company. The tax directorate also probe two other companies under Bakrie for the same indications PT Bumi Resources and PT Arutmin Indonesia.
Judge Prasetyo Ibnu Asamara said the court accepted objection from state prosecutors which argued that a pre court motion has no authorities to decide the case, as pre-court hearings only examine legality of an arrest, detention, cesation of investigation and prosecution, compansation pleas, and rehabilitation for suspects after cesation of investigation and prosecution.
The coal miner is being suspected of evading tax up to Rp 1.5 trillion while the two other Bakrie companies, Bumi Resources and Arutmin is suspected of failing to pay Rp376 billion and US$27.5 million respectively.
